Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the www.AdPtz.com website (the "Service") operated by Panther Software ("us", "we", or "our"), or any related sites used to earn points, or administer your account settings.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
These terms apply to all devices that may access related websites such as a PC, tablets, mobile devices or any device that can view HTML-based websites ("Devices").
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
In addition to the agreed upon Terms of an AdVenturer account, as a Promoter, you must agree to the Terms outlined in this document in order to use our Service for promotional purposes.
You are responsible to learn and understand how the features of the Promoter component of the Service work. Any errors that result in loss of point credits, due to user error, will be your responsibility. You are obligated to update and maintain settings and button html and script ("Button") that are to be placed on the websites you wish to promote.
You are responsible to suspend all Buttons that you have removed from your websites. Failure to do this will result in Bad Button reports by AdVenturers, and this flag will not be removed by support. You will be required to create a new Button and manage it appropriately in the event you forget to do this.
The Service is not guaranteed to bring in traffic in all cases. If you design Buttons which are too restrictive in terms of availability to AdVenturers, it may take several years to generate visits, and consume available credits.
The Service may not be equally used in all regions. As a result, some regions will generate substantially less visits than others. Point Credits will not be refunded should traffic not meet your expectations. Because this is a new marketing Service, you understand that it may take time for popularity to build up to fully consume Point Credits.
You also acknowledge that traffic may be proportional to the amount of points you are offering to visit your website. In busier regions, AdVenturers are limited to how many points they can collect in a day. You will likely need to offer more points to remain competitive with competing businesses. It is your responsibility to recognize the fluctuating supply and demand for Button prices that will lead to a successful visit in your region.
In the event a Button has a technical problem loading, you are responsible for correcting the issue. However, if possible, a link to AdPtz.com will be provided in its place to make it more aesthetically pleasing, and to promote our Services.
You must not promote websites who have shared domain access by untrusted users. For example, http://www.sharedhostingsite.com/yourcompany/yourpage.html is against the Terms because it is possible that http://www.sharedhostingsite.com/othercompany/maliciouspage.html could be used to deplete your balance by copying the Button information from yourpage.html. You are presumed to be the owner, or authorized by the owner of the domain to which you are promoting. Refunds will not be issued in such a scenario.
When pasting a Button on a website, you are the owner of the Button code and accept it 'as-is'.
In the event the system incorrectly adjusts point credit balances, whether in favor, or against what would be the intended behaviour, we reserve the rights to audit and adjust the balance to correct the malfunction.
If a malfunction occurs, Panther Software accepts no liability beyond the financial cost of the Service or credits which were affected. Partial or full refunds of unspent credits are the limit of liability. We will work with PayPal when disputes over financial payments are in question.
You will not be entitled to a refund if malfunctions have been addressed within 30 days of being discovered. Simply claiming the 'system has too many problems' will not be just cause for a refund. In other words, if the problems are fixed, and you are hypothesizing that the problems will occur anyways, this will not be considered a reasonable reason for a refund.
If the Button placed on your website causes distortions or other problems on your website, Panther Software assumes no liability. Use at your own risk. It is advised that you test the compatibility of the Button by viewing it your website's supported browsers. If the Button does not display properly, or other parts of your website are distorted by it, it is your decision to continue using the Service.
Refunds will not be given on points which have been credited to AdVenturer accounts, under any circumstance.
Refunds will not be given on purchased Promoter account upgrades as soon as any benefit gained from the Service upgrade is gained, under any circumstance.
In the event our Service has not met the expected terms outlined in this document, the refund amount will be based solely on outstanding Point Credits, minus any promotional Point Credits given. If you have purchased 50,000 points, and were given 30,000 as part of a promotion, then your maximum amount refundable would be 50,000 credits.
Regardless of the point package purchased, you will be refunded at a rate of $0.01 USD per Point Credit removed. This may result in a net loss to you. In the event you are awaiting a refund, you are responsible to suspend all Buttons so that your Point Credit balance does not further deplete itself before the refund occurs.
Our Service will contain links to third-party websites or services that are not owned or controlled by Panther Software.
Panther Software has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Panther Software shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
In addition, when promoting a website, as a Promoter, you agree that the content you are promoting does not contain illegal or offensive content. In the event such content is detected, you will be temporarily suspended until the content in violation of this term has been rectified. Failure to make the correction, or too many repeat offensives will result in a permanent ban from the Service. If there is a dispute what constitutes offensive content, we reserve the right to refund purchased credits, and suspend your content in order to preserve the integrity of the Service.
It is presumed that browser configurations done to support the AdPtz Service are done so on Devices that do no have conflicting security, performance or technical requirements. If you require conflicting settings, such as disabling scripts, cookies or other requirements on the Device in question, Panther Software assumes no liability for damages incurred by third-party websites or software.
Panther Software assumes no liability for infringements or breaches caused by the usage of our Service in conjunction with other third-party services. In the event your website displays pay-per-click ads, or other third-party services, which do not permit the use of a service such AdPtz, then this is a matter between yourself and the third-party service.
In the event you have honestly and fairly used AdPtz to promote your website, and have not to clearly violated the terms of other third-party services such as search engine and social media websites, you should not expect penalties to your website for using AdPtz.
In the event a penalty is incurred by a third-party service, such as a down-ranking or a blockage to your website, please review the terms of their service and try to resolve the matter directly with them.
In the event the violation that is claimed by the third-party is questionable, and you suspect that the third-party is interfering with the success of the AdPtz service by damaging your popularity through association, feel free to notify your competition regulator. In the US, you may file a report against this company online at https://www.ftc.gov/faq/competition/report-antitrust-violation. In Canada, contact the Competition Bureau online at http://www.competitionbureau.gc.ca/eic/site/cb-bc.nsf/frm-eng/GH%C3%89T-7TDNA5.
In addition to the Fraud terms outlined in the AdVenturer Terms, a Promoter is obligated to be an authorized representative of the web sites they are promoting.
Promoters found to be in cahoots with AdVenturers or other schemes to take advantage of the Service will be suspended, and all related accounts will be as well. Credit purchase which are later claimed to be 'unauthorized' will be investigated by Panther Software and PayPal. If evidence exists that this is a fraudulent claim, in that the points have been depleted from the system after they were deposited, it will not be reversible. If you notice more point credits in your account than you knowingly purchased, you must notify Panther Software immediately, so that they can be removed before they are dispensed to AdVenturers. Authorities may be called in to investigate in some cases.
Purchases made with stolen credit cards or PayPal accounts belonging to other PayPal accounts without the authorization of the owner will be prosecuted.
Fraudulent AdVenturer accounts that collect points from you as a Promoter, whether by running scripts (robots) or possession multiple accounts, are not the responsibility of Panther Software. We will, however, assist in detecting such accounts, and should it be proven that these accounts are not legitimate, upon suspending them and removing their balances, we may, at our discretion, reimburse credits back to you.
As a Promoter, you may be obligated to pay taxes on purchases. The amounts paid at the time of purchase should be listed in your PayPal records. In Canada, for example, the GST may be declared as an input tax credit if this is a registered business. In addition, you may be able to use the PayPal records to declare the purchases as marketing expenses. Consult a local accountant for more details.
When accessing the various websites required to use our Service, as well as our main websites, you agree to use an up-to-date browser which is functioning and compatible with displaying web content correctly. Features such as scripts, cookies, and other popup options may need to be enabled in accordance with this term. It is not the responsibility of the Service to support all browser and security options available on the market.
If a browser, or a component to the browser is updated, and is found to be incompatible with our Service, we are not obligated to modify the Service to be compatible with it. You are responsible for troubleshooting the problems found in your chosen browser.
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of Manitoba, Canada, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Updates to the software will also be done from time to time to address bugs and to alter existing features. Though most features will be enhanced over time, re-calibration, or removal of older features may be necessary in some cases. Program appearance, minimum amounts, fees and package details may be revised as the system evolves. Grandfathered software behaviour and values are not guaranteed.
By continuing to access or use our Service after revisions become effective, you agree to accept the revised Services 'as-is'. If you do not agree to the new terms, stop using the Service.

Panther Software ("us", "we", or "our") operates the www.AdPtz.com website (the "Service"), as well as sites related to account administration.
This page informs you of our policies regarding the collection, use and disclosure of Personal Information when you use our Service.
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your name ("Personal Information").
We collect information that your browser sends whenever you visit our Service ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.
Cash purchases made for our Services will capture the IP Address of the purchase when it occurs.
In the event a dispute occurs over an unauthorized purchase, this information, as well as the IP addresses of the AdVenturer accounts who may have collected these points, will be investigated by Panther Software, as well as PayPal.
Promotions that give point credits or account upgrades will be limited to 1 per IP address. If you genuinely have more than Promoter at the same location, you will be obligated to access the Promotion from a different address in order to collect the promotional offer. This is done to limit the need to investigate fraudulent account creation of multiple accounts, even if these poses an inconvenience to some promoters.
Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer's hard drive.
We use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.
We may employ third party companies and individuals to facilitate our Service (hosts), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.
These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
Your passwords are stored in hashed formats in our secured databases, and thus we cannot directly view them, which is added protection should our servers ever be breached. This, however means we are unable to send you your existing password, as we are unable to decode it ourselves without 'brute forcing' it. If you lose your password, you will need therefore request a new one from a login screen, and follow the link provided in the email to reset it. There is also a time limit to how long after the Reset Password action can be done. This may be inconvenient in some cases, but ensures your account information is highly secured.
We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Our Service does not address anyone under the age of 13 ("Children").
We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your Children has provided us with Personal Information, please contact us. If we discover that a Children under 13 has provided us with Personal Information, we will delete such information from our servers immediately.
